1. The TCPA disclaimer must beshown at all timeswith a submit button in a legible font size and color.  

Font Size Requirements: Min 12px – Max 16px.  Contrast and Background color taken into account. 

TIP:  Requests for TCPA disclaimers above the submit/button CTA has been on the rise.  Case-by-case reviews are applicable. 

Branded:  TCPA disclaimers must be located above the submit button/CTA. Case-by-case reviews are applicable. 

2. The TCPA disclaimer should match in style and content to thebelow example. CTA/Submitbutton must match text within disclaimer. Slight alterations will be reviewed on a case-by-case basis. 

Home Services: By clicking Get My Quotes, I agree to the Terms of Service & Privacy Policy and authorize home service companies, their agents and marketing partners to contact me about home services and other offers by telephone calls, emails and text messages to the number and email address I provided above. I agree to receive telemarketing calls and pre-recorded messages via an autodialed phone system, even if my telephone number is a mobile number that is currently listed on any state, federal or corporate “Do Not Call” list. I understand that my consent is not a condition of purchase of any goods or services and that I may revoke my consent at any time. I understand that standard message and data rates may apply. 

4. TCPA Disclaimer Content Guidelines:

  • TCPA language must contain links to valid and updated: 
    • Privacy Policies and Terms that open in new windows, or within pops w/navigation. 
  • TCPA language must contain a link to an updated & valid partner list.  Partner list must include entries from: Top Home Service Companies 

 

5. Page Footersshould include a Privacy Policy, Terms and either California Residents, or Do Not Contact Link that opens in new windows or within pop w/navigation, which: 

  • Directs consumers to a Do Not Contact request form, and/or have valid and updated California Consumer Privacy Regulations linked.  
  • 2018 California Consumer Privacy Act information MUST be included within California Privacy Regulations.  
  • Privacy Policies MUST have include information specific to California Regulations, and the 1028 California Consumer Privacy Act. 

 

 

6. You must be able totarget on at least a state level while running this offer. Search partners should be targeting on a zip code level. Please download the file below weekly for the most up to date target list.  

7. Publisher agrees that it will download and remove the domainslocatedon the FCC’s wireless domain names list (http://www.fcc.gov/cgb/policy/DomainNameDownload.html) from all current data used in emailing for Offers. Affiliate further warrants that any new data that it acquires, regardless of its source, will be compared against the FCC’s wireless domain names list and that domain names contained therein will be removed before sending any emails. 

8. Verification Tool Guidelines: All sites must have Jornaya Leadid implemented, with an available Jornaya  TrustedForm is a plus.

9. Creative Guidelines:Creatives must NOT include claims such as “free windows,” “free installation,” or any offer suggesting that a product or service is provided at no cost. Creatives must AVOID language that leverages fear, panic, or excessive urgency to drive action These types of claims can be misleading and are not permitted under our compliance standards. 

No Guarantees of any kind  

No Claims Services Are “Free” (Free Consultations are OK)  

No Huge savings claims without any substantiation; no specific savings amounts or percentages. 

No Messaging designed to create a false sense of urgency:  

•  “Time is running out” 
•  “Last chance” 
•  “Act now before it’s too late” 
•  “Don’t miss out” 
•  “Only a few spots left” 
•  “This offer will disappear forever”   

No Messaging that implies the marketer is connected with any Gov’t or State agency  

No Reference to Regulations 

 

No Non-Approved Branding  

No Messaging that implies any connection to any specific brand that sells these services. (In the case of branded or BEC leads, the use of logos and brand names are allowed with approval.) 

No Logos or Emblems That Indicate Government Connection: State Flags, State Seals, or any logo or seal of a government agency. 

 

10. Contractor shall be solely liable for all Contractor Ads used in connection with this Agreement

11. Contractor shall ensure that all Contractor Adscomply with applicable Law at all times 

12. Contractor shall not make any material misstatements or omissions in any Contractor Ads as it relates to the applicable marketing offer.

13. It is the Publishers’ contractual and legal obligation to ensure that every direct and indirect marketing claim used to generate leads must be truthful and properly substantiated in compliance with applicable federal and state marketing laws. This means that Publishers must have a documented and reasonable basis for making all claims beforedisseminating such claims publicly. 

14. Restrictions on Publisher’s Use of BrandedTerms : Publisher cannot bid on branded terms. 

15. Vendor may bid on keywords, including thosecontainingSEARS-branded terms, only if it complies with the following limitations: 

SEARS Vendor are prohibited from bidding on the branded keywords “Sears” or “Sears Home Services” or “Sears Home Improvement” or “Sears Home Improvements” or any other SEARS keywords specifically listed below. 

If the Vendor bids on SEARS-branded keywords other than those prohibited below, including branded product keywords, for their own website or an SEARS branded site, it must use commercially-reasonable efforts to cause the paid search engine results of the landing pages, websites, microsites, ads and other components operated and/or managed by the Vendor to appear in a lower resulting position than any SEARS results that appear in the search engines. 

If the Vendor is using paid search, then the Vendor may bid on the services or products as well as on SEARS-branded keywords other than those prohibited below, provided the Vendor maintains a lower resulting position than any SEARS than any SEARS results that appear in the search engines, unless otherwise approved (at the keyword level) to be in another position in writing by SEARS. 

SEARS Vendors are prohibited from using the SEARS name as a brand term in paid search, and it must be set as a negative search term in broad, exact and phrase matches by the Contractor. 

The Vendor is prohibited from using the brand term “Sears” in its actual ad copy unless that term is being dynamically generated based on the actual term searched. 

16. KEY WORD LIMITATIONS

Titles/Descriptions – Vendor must not use any Sears Marks (as defined in the Agreement) in any title or description to drive traffic directly to SEARS from a search engine, unless specifically allowed above. 

Domain Names – Vendor must not register or use (1) any Sears Marks (as defined in the Agreement) in any domain names or (2) any trademark of any of SEARS’s competitors in any domain names for the purpose of driving traffic to SEARS.
